Section
201 VS. antidumping -- How do they differ ? |
| Published
on February 1, 2001 |
In March 2000, a group
called the Blue Crab Coalition filed a Section 201 petition
against Thai crab to temporarily restrict imports into
the United States. However, lead opponent Phillips Foods
lobbied to convey to the Clinton Administration the extensive
domestic opposition to the petition. As a result, on July
11, 2000, the International Trade Commission (ITC) voted
4-2 to reject trade restrictions , thereby allowing Thailand
to continue exporting to the US without additional tariffs,
duties or quotas.
In 1994, Thai processors
captured 46% of the US import market for canned pineapple.
Maui, the only US-based producer, struggled to compete
with resulting depressed world pineapple prices and thus
felt forced to file an antidumping petition with the US
Department of Commerce (DOC). In May, 1995, based on results
of the DOC investigation, the ITC voted 6-0 to impose
antidumping duties , ranging from 1% to 51%, on imports
of canned pineapple from Thailand. The Sunset Review,
due for completion by June 30, 2001, will determine whether
these duties remain for another five years. |
